12 months or 20,000KM Warranty Policy

This warranty policy is in addition to any other warranties provided by, or under any legislation, including the Trade Practices Act.

The seller warrants that it will, as its option, replace, refund the price of or give a credit in relation to any goods which prove to be faulty in respect of materials or workmanship ("the warranty").

The Warranty shall be valid for a period of twelve months or 20,000 km, whichever occurs first, from the date of installation into a vehicle.

The warranty shall not apply:

A. Where the goods have been in Martin's Clutch & Brake's reasonable option, subject to any misuse, negligence, fire, accident or racing conditions or have been subject to repair or dismantling not authorised by Martin's Clutch and Brake.

B. Where the goods have been fitted to vehicles that have been modified.

C. To parts only damaged by wear and tear by reason of normal usage.

D. To any goods, notwithstanding the other provisions of this clause, where the Buyers does not forthwith do each of the following.
Inform the seller of the said defect on discovering the defect or on reasonably suspecting the existence of the side defect; and
Return the purportedly defective Goods, at the Buyer's own cost, together with the completed Seller warranty claim form and proof of the purchase date of the goods;

E. To second hand Goods; and

F. To goods sold at a disposal sale or auction.

Notwithstanding the other terms and conditions herein, Martin's Clutch and Brake's liability under the Warranty shall be limited to the replacement of the Goods, refund of the purchase price or allowing credit in relation to the Goods.

Martin's Clutch and Brake's no-fault policy and procedure and replacement of or credit in relation to any goods shall not constitute, and its customers and customers should not construe that replacement, refund or credit as an acceptance of liability or an admission of negligence or fault by Martin's Clutch and Brake.
